By accessing and using trackME ("the Service"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use the Service.
These terms apply to all users of trackME, including teachers, school administrators, and individual users.
2. Description of Service
trackME is an educational progress tracking application designed for Australian teachers to:
- Track student progress against curriculum standards
- Record skill and knowledge completion
- Create and manage assessments
- Generate progress reports and analytics
- Manage classes and student rosters
The Service is provided "as is" and may be modified, updated, or discontinued at any time.
3. Eligibility
trackME is designed for use by:
- Registered teachers and education professionals
- School administrators
- Individual educators
You must be at least 18 years old to use trackME. By using the Service, you represent that you meet these eligibility requirements.
4. Account Registration and Security
4.1 Account Creation
To use trackME, you must:
- Create an account with a valid email address
- Choose a secure password
- Provide accurate information
- Maintain the security of your account
4.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your password
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
- Using two-factor authentication when available
4.3 Account Termination
We reserve the right to suspend or terminate accounts that:
- Violate these Terms of Service
- Engage in fraudulent or illegal activity
- Are inactive for extended periods
5. Acceptable Use
You agree to use trackME only for lawful educational purposes. You must not:
- Use the Service to store or process inappropriate or illegal content
- Attempt to gain unauthorized access to other users' data
- Interfere with or disrupt the Service
- Use automated systems to access the Service without permission
- Share your account credentials with others
- Use the Service to violate any laws or regulations
- Upload malicious code or attempt to compromise system security
6. Student Data and Privacy
6.1 Data Entry
You are responsible for:
- Ensuring you have appropriate consent to enter student data
- Entering accurate and up-to-date information
- Complying with your school's privacy policies
- Complying with Australian Privacy Principles
6.2 Data Ownership
You retain ownership of all data you enter into trackME. However, by using the Service, you grant us a license to store, process, and display this data as necessary to provide the Service.
6.3 Data Deletion
You can delete student data at any time through the Service. Deleted data is permanently removed from our systems and cannot be recovered.
7. Intellectual Property
7.1 Our Content
All content, features, and functionality of trackME, including but not limited to text, graphics, logos, and software, are owned by Simon Dass and are protected by Australian and international copyright laws.
7.2 Your Content
You retain ownership of all data and content you upload to trackME. By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and display this content as necessary to provide the Service.
8. Service Availability
We strive to maintain high availability of the Service but do not guarantee:
- Uninterrupted or error-free operation
- That the Service will meet your specific requirements
- That defects will be corrected
We reserve the right to:
- Perform maintenance that may temporarily interrupt service
- Modify or discontinue features
- Suspend service for security or legal reasons
9. Limitation of Liability
To the maximum extent permitted by Australian law:
- trackME is provided "as is" without warranties of any kind
- We are not liable for any indirect, incidental, or consequential damages
- Our total liability is limited to the amount you paid for the Service (if any) in the 12 months preceding the claim
- We are not responsible for data loss due to user error, system failures, or third-party actions
Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
10. Indemnification
You agree to indemnify and hold harmless Simon Dass, trackME, and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms of Service
- Your violation of any rights of another party
- Any content you upload or data you enter
11. Data Export and Backup
trackME provides data export functionality. You are responsible for:
- Regularly exporting and backing up your data
- Maintaining your own backups
- Ensuring exported data is stored securely
We are not responsible for data loss if you fail to maintain backups.
12. Modifications to Terms
We reserve the right to modify these Terms of Service at any time. We will notify users of significant changes by:
- Posting a notice in the app
- Sending an email to registered users
- Updating the "Last updated" date
Continued use of trackME after changes constitutes acceptance of the updated terms.

13. Termination
13.1 By You
You may terminate your account at any time by:
- Deleting your account through the Settings page
- Contacting us to request account deletion
13.2 By Us
We may terminate or suspend your account immediately if you:
- Violate these Terms of Service
- Engage in fraudulent or illegal activity
- Fail to pay required fees (if applicable)
14. Governing Law
These Terms of Service are governed by the laws of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.
